1. Sport Kessler. Sport Kessler offers vouchers for services provided by third parties and for its own services.

2. Vouchers. Sport Kessler purchases vouchers from providers for the providers' services or, alternatively, the providers make the vouchers available to Sport Kessler. Sport Kessler then sells the vouchers to customers in its own name and on its own account.

There are two types of vouchers: Value vouchers and service vouchers.

The providers are exclusively business entities, such as the HGV (Hoteliers- and Gastwirteverband), hotels, restaurants, service providers, or retailers. The purchasers of vouchers may be either consumers or businesses.

3.„Sport Kessler“ Vouchers. In addition to the vouchers mentioned in point 2, Sport Kessler also sells vouchers for its own services and sells them in its own name and on its own account to purchasers of vouchers.

These vouchers may be either value vouchers or service vouchers.

The purchasers of vouchers may be either consumers or businesses.

4. Purchasing a voucher. To purchase the vouchers, the voucher purchaser selects the desired vouchers, enters their contact and payment details and pays using one of the specified payment methods.
Sport Kessler issues the vouchers once the purchase has been completed and payment has been made in full by the voucher purchaser. The value of the voucher and the voucher code are printed on the voucher; in the case of service vouchers, a description of the service is printed.

5. Type of vouchers. Vouchers purchased via Sport Kessler can be pure value vouchers.
The value of the voucher corresponds to the purchase price paid by the voucher purchaser to Sport Kessler for the voucher. The voucher purchaser is entitled to purchase services from the provider or, in the case of vouchers as defined in point 2, from Sport Kessler, to the value of the voucher. Depending on the voucher, this may be limited to certain types of services or may include all services of the provider or Sport Kessler.

The value of the voucher does not have to be redeemed all at once, but can also be redeemed partially. If only part of the voucher is redeemed, the remaining value does not expire but remains valid and can be redeemed at a later date.

The voucher expires in accordance with the statutory provisions.

A service voucher entitles the voucher purchaser to utilise the service defined in the service voucher. The actual service provided by the provider or Sport Kessler may deviate slightly from the defined service and in particular from the depiction in photos, or even further, if there are good reasons for doing so.

The redemption of a service voucher may be subject to compliance with certain dates, deadlines or conditions, otherwise the service voucher shall expire in accordance with the statutory provisions. The purchaser of the voucher is responsible for ensuring that they can meet any deadlines, time limits and conditions.

6. Redeeming a voucher. The vouchers entitle the voucher purchasers to redeem the value or, in the case of service vouchers, to utilise the services with the respective provider in accordance with their terms and conditions or with Sport Kessler in accordance with their terms and conditions.

To redeem the voucher, the voucher must be presented in printed or digital form to the provider or to Sport Kessler.

Vouchers cannot be redeemed in cash either at Sport Kessler or at the provider.

7. Transferring a voucher. In principle, the vouchers are freely transferable to a third party by the voucher purchaser. This does not apply to employee vouchers issued by Sport Kessler to employees of service companies (primarily hotels) or partner companies. These vouchers can only be redeemed by the respective employee or only by the respective partner company for which they were issued and are not transferable to third parties

8. Liability for the vouchers. In the case of vouchers that relate - even if only partially - to services provided by suppliers, Sport Kessler is only liable for the validity of the voucher, i.e. that the right to the service specified in the voucher actually exists.
However, Sport Kessler is not liable for the creditworthiness of the voucher, i.e. for the creditworthiness and insolvency risk of the provider, nor for the quality of the provider's services. Excluded from this are credit and insolvency risks and quality defects that Sport Kessler was aware of or should have been aware of at the time of the voucher sale.

The purchaser of the voucher is in any case responsible for the safekeeping of the voucher code.

9. Return or cancellation of vouchers. I In the event of loss, it is generally not possible for Sport Kessler to block the voucher code, as Sport Kessler has no means of checking who is the rightful owner of the voucher or authorised to dispose of it at the time of any blocking request due to the free transferability of the vouchers.

This does not apply to employee or partner company vouchers within the meaning of point 7. In the event of loss, the respective voucher code can be blocked by Sport Kessler upon presentation of a photo ID.

It is not possible to return vouchers to Sport Kessler. Excluded from this is a return within the scope of the statutory right of cancellation in distance by the voucher purchaser.

10. Further services. Sport Kessler also provides additional services for suppliers. Sport Kessler acts exclusively as a contractual partner of the providers. If customers of the providers have any questions about these services, the respective providers will be happy to answer them.
